13 December 2025 Supreme Court of Canada case Walker v. Kierans

Описание: Hi my name is Kathleen Walker and I have been looking out for my brother Paul Kierans since he was born profoundly mentally handicapped with Down Syndrome in 1958. Paul and I have resided near each other in greater Vancouver and visited at will since 1990.

On September 12, 2022 a lawyer with Paul's group home permanently terminated Paul's visits with me, his last surviving, local family in-person visitor. The lawyer cut off our contact when I complained to the Burnaby RCMP police about a secret representation agreement that the group home created, granting all of Paul's civil rights to our 81-year-old Catholic nun sister 4,000 km away in Ontario. No other family member was told and Paul did not have legal advice. The document was witnessed by the group home's own employees. In my opinion it is a fraud and a forgery.

On February 1, 2022 I had petitioned to be Paul's guardian so that I could restore our visits. I was not successful as l was up against the government of British Columbia and the Catholic church.

On April 9th 2024 when the nun discovered that the Burnaby police were ordered by Ottawa to investigate her document granting her guardianship of my brother Paul, she applied to the court to have me declared a "vexatious litigant" taking away all my civil rights and right to defend myself in court. Her intent was to discredit me as a witness in the RCMP investigation.

My brother Paul died on April 23rd 2024 but the nun pursued her claim of vexatious litigant against me and had me designated a vexatious litigant on November 29th 2024. my appeal of that designation to the court of appeal of British Columbia was dismissed.

I'm now applying to the Supreme Court of Canada to set aside my designation as a "vexatious litigant" which takes away my access to Canadian courts, even to defend myself. I am a pensioner on old age security and I've used all my money and all that I can borrow to pay for this litigation. The finding of me as a vexatious litigant is a hurtful stain on my reputation and will have a chilling effect on people who want to support their loved ones in their declining years.

The British Columbia government and the Catholic Church have infinite wealth. My brother's isolation & confinement to his group home for 588 days, and my sister's pursuit of me after his death, is in my view is the worst miscarriage of justice in British Columbia history.
