Generative AI enables human artists to create art much faster, increasing productivity. It also provides unique opportunities for human artists to create novel art beyond their imaginations. However, it also challenges the current legal system surrounding the art industry in a disruptive way. To begin with, it challenges the assumption of the copyright system that humans are the sole creators of art. In addition, the art industry value chain restructured with the advent of generative AI raises challenging legal issues that the current copyright system cannot clearly explain. The speaker addresses three significant legal issues concerning AI-generated art.
First, does it constitute copyright infringement to train generative AI with the works created by human artists without prior permission? The speaker will analyze the contemporary copyright law to solve the puzzle and discuss policy ramifications for the future copyright system. Two legal disputes over generative AI are discussed: the copyright infringement lawsuit filed by Getty Images against Stable Diffusion and the copyright infringement class action filed by many artists against Stable Diffusion.
Second, who is the author (artist) of works created by a generative AI? Currently, copyright laws in most countries recognize humans as the only authors or artists. While humans create AI, AI creates art independently, without human supervision or intervention. The only human role is for users to enter prompts. Several policy options suggested by legal professionals and scholars are: (1) to attribute authorship to any human stakeholder(s) in the generative AI ecosystem; (2) to recognize the legal personality of the generative AI itself; (3) to establish a new class of works-made-for-hire; (4) or consider AI-generated art as dedicated to the public domain.
Third, do works created by generative AI infringe copyrights of original artworks created by humans? This particular question can be answered within the framework of the current copyright system. So, the criteria for determining infringement in the current copyright system are discussed based on AI-generated art examples. There is also room for legislative reform to deal with copyright infringement cases in this part.
Currently, the U.S. Copyright Office (“USCO”) is seeking public comment on copyright law and policy in light of the emergence of generative AI. The USCO is particularly interested in how much transparency and disclosure should be required in training generative AI and how the legal status of AI creations should be viewed. The speaker will argue that (1) there are limitations to addressing the issues under current copyright law; (2) new rules are essential to recognize the benefits of generative AI and reinforce the philosophical foundation of the copyright system that protects ‘human’ artists and fosters fair uses of artworks.

생성적 AI는 예술가들이 생산성을 크게 높이며 더 빠르게 예술작품을 창작할 수 있게 한다. 또한 예술가들에게 상상 이상의 새로운 예술을 창작할 수 있는 독특한 기회를 제공하기도 한다. 그러나 이는 예술 산업을 둘러싼 현행 법률 시스템에 반대되는 방향으로 도전한다. 우선, 인간이 예술의 유일한 창작자라는 저작권 법률의 가정에 어긋난다. 또한, 생성적AI의 등장으로 재구성된 미술산업 가치들은 현재의 저작권 법률로는 명확하게 설명할 수 없는 법적 문제를 제기하고 있다. 연사는AI 생성 예술과 관련된 세 가지 중요한 법적 문제를 다룬다.
첫째, 인간예술가가 사전 허가 없이 창작한 작품으로 생성적 AI를 훈련시키는 것은 저작권 침해에 해당될까? 강연자는 현대의 저작권법을 분석하고 미래 저작권 시스템에 대한 정책적 파급효과에 대해 논의할 것이다. 생성적 AI와 관련된 두 가지 법적 다룰 것이다. Getty Images가Stable Diffusion을 상대로 제기한 저작권 침해 소송과 다수의 예술가가Stable Diffusion을 상대로 제기한 저작권 침해 집단 소송이다.
둘째, 생성적 AI가 만든 작품의 작가(예술가)는 누구인가? 현재 대부분의 국가의 저작권법은 인간을 유일한 작가 또는 예술가로 인정한다. 인간이AI를 만드는 반면, AI는 인간의 감독이나 개입 없이 독립적으로 예술 작품을 만든다. 유일한 인간의 역할은 사용자가 프롬트를 입력하는 것이다. 법률 전문가와 학자들이 제안하는 몇 가지 정책 옵션은 다음과 같다.

(1) 생성적 AI 생태계의 모든 인간 이해관계자에게 저작권을 부여한다.
(2) 생성적 AI 자체의 법적 성격을 규범한다.
(3) 새로운 기회를 위해 형태의 위임 제작 작품의 범주를 설정한다.
(4) AI로 생성된 예술을 공공 도메인으로 지정하는 것을 고려하는 것이다.

셋째, 생성적 AI가 만든 작품은 인간이 만든 원본 작품의 저작권을 침해할까? 이 질문은 현재 저작권 시스템 내에서 답할 수 있다. 현재 저작권 시스템에서 침해 여부를 판단하는 기준은AI가 생성한 예술 사례를 중심으로 논의된다. 이 부분에서도 저작권 침해 사건을 다루기 위한 법률 개정의 여지가 있다.
현재 미국 저작권청(“USCO”)은 생성적 AI의 등장을 고려하여 저작권법 및 정책에 대한 대중의 의견을 구하고 있다. USCO는 특히, 생성적 AI교육에 어느 정도의 투명성과 공개가 요구되어야 하는지, AI 창작물의 법적 지위를 어떻게 보아야 하는지에 관심을 보이고 있다. 연사는(1) 현행 저작권법 하에서 문제를 해결하는 데 한계가 있고, (2) 생성적 AI의 이점을 인정하고'인간' 예술가를 보호하며 예술 작품의 공정한 사용을 촉진하는 저작권 시스템의 철학적 기반을 강화하기 위해 새로운 법률이 필요하다고 주장할 것이다.
