The finality of your divorce. A divorce with minor children can easily go a minimum of six months. It can easily go 6 to 12 as parties are wrangling back and forth and doing a lot of horse-trading. At some point, that case will go to trial. There will be a judgment based on that. There parties can have a settlement. Judgment will be based on that settlement. It will be resolved. The question is the finality. Is the judgment of divorce final? Can your ex-spouse change the terms of the judgment of divorce? The quick answer is NO. It's done. The judgment says what everybody gets. That's it. Having said that. It's possible to make certain modifications under very limited circumstances. You can't modify it based on buyer's remorse. You can modify it based on fraud. Modify it if you learn someone hid some assets. Bring it to the attention of the court. Unless you have a substantial reason behind it. Unless you can show compelling evidence the court will not likely modify it. At least this is the case with property settlement. There are some things that are never final. Custody and child support are never final. Parenting time is never final. The court can always do that. The court of course doesn't do it on its own. Appropriate motions have to be filed. Present compelling evidence of substantial change in circumstance.
