Pursuant to a court order, the United States of America, the defendant in the Camp Lejeune Water Litigation, provided a Notice of CLJA Settlement Status Pursuant to Court Order on February 26, 2026. This video describes the update provided, including the total number of cases filed for litigation in the Eastern District Federal Court of North Carolina to date and the number of those cases resolved under the Elective Option (EO) broken down by injury type. We do the same for the cases that have been administratively filed with the Department of the Navy, but are not yet filed with the federal court for litigation.
While the U.S. government is extending EO offers to claimants and the data shows that more than 90% of those EO offers have been extended, the overall number of claims resolved to date as compared to the more than 400,000 deduplicated claims filed is nominal. Progress is slow as the parties continue to proceed through the discovery phase and enter into a more technical phase of the litigation where important issues of evidence and offsets are being debated.
Specific to the subject of offsets, the Camp Lejeune Justice Act (CLJA) provides that there will be offsets applied to the awards for claimants provided benefits by Medicare, Medicaid, and the VA. The Plaintiff's Leadership Group believes those offsets should only apply to benefits paid in the past while the US Government argues that the offset should also apply to future benefits to be paid once a claim is resolved. We expect this issue to be ruled upon by the court later in 2026.
