DJI vs FAA: Who makes the VLOS rules?

In case you don't know, the Federal Aviation Administration (FAA) has a rule for drone pilots that sUAS (DRONES) cannot fly outside of Visual Line of Sight (VLOS), meaning you need to be able to see your drone in the sky.
So tell me why drone manufacturers like DJI make their drones capable of flying 12 miles away from the controller (or more)? Do you think you could see a 249 gram drone 20 km away? I don't think so!
So what do you think? Is the FAA right for mandating a distance level, or is DJI right for making drone range as far as possible?
