Does release by personal representative bar claims in probate case?*

Описание: An estate is sued, then a settlement signed. Did trial court err bar claims that accrued after lease signed? The scope of the Release was not broad enough to release U-Haul from the contractual claims asserted in the underlying action. It follows that the circuit court erred in granting the summary judgment and in entering a final judgment in favor of U-Haul. Accordingly, we reverse the order granting the summary judgment and the resultant final judgment. We remand this case to the circuit court for further proceedings consistent with this opinion.

Reversed and remanded for further proceedings.
