Can a government compel commercial or professional speech when the speaker disagrees with the message? Andrea Picciotti-Bayer of the Catholic Association Foundation and Meggan Dewitt of the Cato Institute discuss an upcoming Supreme Court case on whether two provisions of the California Reproductive FACT Act violate free speech protections for crisis pregnancy centers.
JUDGMENT: June 26, 2018. Reversed and remanded, 5-4, in an opinion by Justice Thomas. Justice Kennedy filed a concurring opinion, in which Chief Justice Roberts and Justices Alito and Gorsuch joined. Justice Breyer filed a dissenting opinion, in which Justices Ginsburg, Sotomayor, and Kagan joined.
HOLDING: The licensed notice in the California Reproductive FACT Act likely violates the First Amendment.
