White House correspondent Tom McCullagh delivers a special report breaking down the explosive opening statements from the Milwaukee federal courthouse. Prosecutors laid out their case that on April 18th Good Friday Judge Dugan spotted plainclothes ICE agents sitting on a bench waiting to detain Eduardo Flores Ruiz a Mexican national in the country illegally. Security footage shows Dugan approaching the agents and ordering them to the chief judge’s office while pointing through double doors. Moments later with the agents removed from the hallway Flores Ruiz and his attorney exited through a different door and headed for the basement exit. He was caught after a foot chase on 10th Street but prosecutors say the arrest should have happened lawfully inside the courthouse without judicial interference.

The most devastating blow to Dugan’s defense came months ago when a federal judge ruled she does not have immunity. That ruling cleared the runway for prosecution and sent a message to every rogue judge in America that the bench does not place anyone above the law. Opening statements revealed Dugan allegedly told the agents to get out. She knew ICE was there. She intervened anyway. And she later admitted she would take heat for what she did. Well the heat has arrived.

Defense attorney Steven Descoopic who is a former federal prosecutor argued there was anger confusion and paranoia over a lack of policy for how Milwaukee judges should handle ICE agents. But critics are not buying it. Criminal defense attorney Julius Kim told reporters the evidence is straightforward and both sides hope to have the case to a jury by Friday December 19th. Nine men and five women make up the jury including two alternates from counties across Wisconsin.

Outside the courthouse protesters gathered claiming the prosecution is an effort to intimidate judges nationwide. One activist said Dugan is on trial for daring to defend the rights of immigrants. But here is the reality. The courtroom is where due process occurs. Dugan allegedly denied that process by obstructing federal agents performing their lawful duties. The irony is staggering.
