A defendant on deferred adjudication for possession of a controlled substance returned to court after violating the terms of his supervision. Prosecutors alleged he failed to report to probation for multiple months. When questioned in court, the defendant admitted the violations and also acknowledged using marijuana for several months following a vehicle accident that he said caused anxiety and disrupted his life. The judge then presented the defendant with two options: accept a one-year state jail sentence immediately or continue supervision with a treatment evaluation that could require inpatient rehabilitation. After a brief pause, the defendant made a surprising decision in open court — choosing the one-year sentence. The court revoked supervision, found him guilty, and sentenced him to one year in a state jail facility with credit for time served and a recommendation for therapeutic programming.
