We’ve got a drinking holiday coming up. Arrange for a sober ride home. If you find yourself in a sticky situation where you have had a drink and you’re stopped for a DUI should you refuse to blow?
In Michigan, a preliminary breath test refusal is a fine and nothing more. In most cases, I recommend you refuse the preliminary breath test.
Refusing the PBT doesn’t mean you won’t get arrested, but you could have a stronger defense in court.
If you are arrested, the next test is the implied consent test which will be a blood draw or a more elaborate breath test. Refusing this test is 6 points and you will lose your license for a year. In 99 cases out of 100, if you refuse the implied consent test, an officer will be given a warrant for your blood and they will get the evidence anyway.
Easy way to remember: Preliminary Breath Test is preliminary to your arrest. Implied Consent Test is after the officer tells you that you are arrested (if the cuffs go on you’re under arrest).
