The 28th Amendment

The Article V Convention Clause in the U.S. Constitution acts as a type of backstop, or constitutional health insurance policy in the event the government should become corrupt. It is the only peaceful constitutional remedy provided when the U.S. Congress will not propose necessary constitutional amendments, especially amendments which would add more representatives or Senators and dilute the power of each individual Representative or Senator in the U.S. Congress.

This video presents a proposed 28th Amendment to the U.S. Constitution, which would allow the American People to vote to begin their own U.S. Constitutional Convention for proposing constitutional amendments. There would be a vote every four years at the same time as each Presidential election. A 2/3 vote of the electorate would be required for such an amendments convention to begin, paralleling the current Article V which delegates power to the state legislatures, and only the state legislatures, to begin an Article V Convention upon 2/3 vote of the state legislatures.

Why hasn't the United States ever had a second constitutional convention? In large part because the Article V Convention Clause itself is defective. Article V allows state legislatures to hold the American People constitutional hostage, preventing us from making fundamental and necessary changes to the System of Representation.

It appears the Federalists did not tell the truth about the Constitution. They promised us two paths to constitutional amendment, one through Congress proposing amendments and one through a Convention of the People, per Article V, for the special purpose of amendment. When amendment by government is the only constitutionally available path to constitutional amendment, then you don't have a republican (directly representative) form of government, and the Guaranty of a Republican Form of Government in Article IV, Sec. 4 is not met. Per the original American Theory of Free Government, if the Guaranty is not met, the People are morally justified in withdrawing their Consent to Be Governed. This is the reason why the People must assemble in convention, to fix this fundamental problem before it exacerbates in an erosion of respect for the Rule of Law.

The Framers of the U.S. Constitution assumed that the state legislatures are not competent to address national issues. Yet they assigned the only power to start a national constitutional convention to the state legislatures, without any evidentiary support that such was a safe assumption. Madison's later admissions (in private 1821 papers, III Farrand's Records 450-455) that the U.S. Constitution is not democratic or republican, but aristocratic, helps to explain why this defect is here.

This proposed 28th Amendment fixes the defect by giving the American People a direct path to begin an Article V Convention of the People, for deliberating and proposing constitutional amendments, but still subject to the High Bar of Ratification, approval by 3/4 of the states.
