Workplace Dermatitis Explained
Dermatitis and eczema can be extremely painful and disruptive, affecting both work and daily life. Simple preventative measures — such as providing appropriate protective gloves and equipment — can significantly reduce the risk of injury.
While employees must use the protective equipment provided, employers have a legal duty to assess risks and actively protect workers through safe systems of work.
Employer Duties Under Irish Law
Under the Safety, Health and Welfare at Work Act 2005, employers must:
Ensure employee safety, health and welfare so far as practicable
Manage work activities to prevent foreseeable harm
Carry out workplace risk assessments
Provide and maintain a safe workplace and equipment
Prevent exposure to harmful substances
Supply appropriate personal protective equipment (PPE)
Provide training, instruction, supervision and information
Maintain welfare facilities
Plan emergency procedures and report accidents
Engage competent safety professionals where required
Section 62 of the Health and Safety Act 2007 requires employers to provide PPE where risks cannot be avoided by other means.
Employee Protection from Dismissal
Under Section 6(2)(c) of the Unfair Dismissals Act 1977, an employee is protected from dismissal where it results from bringing, threatening, or participating in civil proceedings against their employer.
