Contracts Which Can Be Specifically Enforced
Specific Performance is a remedy provided under the Specific Relief Act, 1963 (SRA), which compels a party to perform the exact terms of a contract, rather than merely paying damages for its breach.
In other words, it enforces the actual performance of a contractual obligation.
ನಿರ್ದಿಷ್ಟ ನಿರ್ವಹಣೆ ಎಂದರೆ ಒಬ್ಬ ಪಕ್ಷವು ಕರಾರುದ ಉಲ್ಲಂಘನೆ ಮಾಡಿದರೆ, ಕೇವಲ ಪರಿಹಾರವನ್ನು ನೀಡುವುದಲ್ಲದೆ, ಕರಾರುದ ನಿಜವಾದ ನಿರ್ವಹಣೆಯನ್ನು ಕೋರ್ಟ್ ಆದೇಶಿಸುವುದು.
It is an equitable remedy—that is, it is based on the principles of equity, fairness, and good conscience, rather than a matter of right. Courts have discretion in granting this relief.
ಇದು ಸಮನ್ಯಾಯದ ಪರಿಹಾರವಾಗಿದೆ, ಅಂದರೆ ನ್ಯಾಯ, ನಿಷ್ಠೆ ಮತ್ತು ಉತ್ತಮ ಮನಸ್ಸಿನ ಆಧಾರದ ಮೇಲೆ ನೀಡಲಾಗುತ್ತದೆ. ಕೋರ್ಟ್ಗೆ ಇದರ ಬಗ್ಗೆ ವಿವೇಕಾಧೀನಾಧಿಕಾರ (Discretion) ಇದೆ.
