How fresh does milk have to be to be considered fresh? According to a new set of labeling rules announced by the FDA last year, imported milk with a shelf life of more than 30 days could still count as fresh milk. That’s as long as the labeling clarified that it was “extended shelf life, or ESL fresh milk.” The rules were set to take effect in July, but that has changed amid complaints from dairy companies.
Dairy farmers say the inclusion of the word “fresh” could mislead consumers, as locally produced fresh milk has a much shorter shelf life. They petitioned on numerous occasions to ban the word “fresh” from imported ESL milk, which is treated to stay fresh for 30 to 90 days. Now the FDA says only milk with a shelf life under 14 days can be labeled as “fresh milk,” whether domestically produced or imported.
