Texas law provides for the enforcement of a no contest clause in a will. But only under certain circumstances. An executor may claim that a beneficiary who challenges the executor's handling of the estate violates the no contest clause. But a court is rarely going to allow an executor to use a no contest clause as a shield to avoid responsibility for failure to abide by their fiduciary duties.
