[L217] CONSTRUCTIVE DISMISSAL | WORKPLACE HARASSMENT

Описание: Constructive Dismissal is defined in Section 186 of the Labour Relations Act ("the Act") which sets out the meaning of dismissal in terms of the Act. Constructive Dismissal is "an employee terminated a contract of employment with or without notice because the employer made continued employment intolerable for the employee".
From the definition, one will immediately note that for a Constructive Dismissal to occur, the Employee would have needed to terminate a contract of employment
The newly introduced Code introduces principles on the prevention and elimination of harassment in the workplace
The new Code is much broader and covers all forms of harassment against women, men, LGBTQIA+ and vulnerable persons in the Workplace.
The new Code expands the definition of harassment in the workplace to include types of workplace bullying, which can help you in your constructive dismissal case.
