On November 12, Congress passed a bill, and President Trump signed it to reopen the government after 43 of days of a government shutdown. This was the longest federal government shutdown in the history of the United States. Our panelists will examine the unprecedented role the federal courts played during the most recent government shutdown. Far from being passive observers, the judiciary was thrust onto the front lines and forced to adjudicate high-stakes emergency cases that carried life-altering consequences for millions. During this administration, we continue to see example after example of executive overreach, and the federal courts remain the only backstop, as the legislative branch has seemingly abandoned their authority as a co-equal branch of government.

One of those decisions involved the Supplemental Nutrition Assistance Program (SNAP). Judicial orders dictated that the Trump administration must fund the program, but there was a subsequent high stakes appeal that reached the Supreme Court. In a mind-boggling decision, the Supreme Court temporarily blocked this order, meaning millions will go hungry. Lawsuits were filed challenging the legality of reductions in force (RIFs) and mass layoffs of federal employees during the government shutdown. Federal courts also intervened to protect the livelihoods of the federal workforce.
