Nations worldwide establish relationships across various domains, including economics, politics, culture, and security matters. These relationships are overseen by international law, which have the rights and responsibilities of states. The origins of international law, as stipulated in Article 38(1) of the Statute of the International Court of Justice (ICJ), include Treaties, Customary practice, General legal principles, judicial decisions, and scholarly writings, collectively forming a structured framework for state interactions.
At the core of international relations lie principles such as sovereign equality, non-intervention, peaceful dispute resolution, and the prohibition of the use of force. Following Article 2(1) of the UN Charter, all states, irrespective of their size or wealth, are considered equal under international law. Article 2(7) of the UN Charter forbids interference in a state's domestic matters/ affairs, while Article 2(4) prohibits the threat or use of force against any state's territorial integrity or political independence, except in cases of self-defense as outlined in Article 51.
The UN assumes a pivotal role in international relations, mandated by Article 1(1) of the UN Charter to uphold international peace and security, foster amicable relations among nations, and tackle global challenges. The UN's involvement in domestic affairs is confined to situations where there is a threat to international peace and security, authorized under Chapter VII of the UN Charter.
Furthermore, General Assembly Resolution 46/182 (1991) stresses the necessity of international collaboration in addressing humanitarian concerns while upholding states' sovereignty.
Ultimately, upholding state sovereignty while fulfilling international commitments is indispensable for upholding a stable global order. Article 55 of the UN Charter advocates for universal respect for human rights, while the Responsibility to Protect (R2P) doctrine, endorsed in the 2005 World Summit Outcome Document, justifies intervention solely in cases where a state neglects to prevent severe human rights violations.
These frameworks ensure that states are answerable to their international obligations while safeguarding their sovereignty and fostering international cooperation.
