This lesson introduces the student to elements that must be present in all intentional torts: (1) intent, (2) volition, (3) causation, and (4) an act. Without all four, there is no intentional tort.
This analysis is meant to be undertaken before analyzing the specific intentional torts (such as battery or assault).

LAW SCHOOL/BAR EXAM ALGORITHM:
Step 1: Did the defendant intend to harm the plaintiff?
If no, then there is no intentional tort. But still, consider whether negligence may apply.
If yes, then move to Step 2.
Step 2: Did the defendant have volition in causing harm to the plaintiff?
If no, then there is no intentional tort. Again, consider whether negligence applies instead.
If yes, move to Step 3.
Step 3: Did the defendant’s actions cause harm to the plaintiff?
If not, stop here. Again, consider if negligence may apply.
If yes, an intentional tort has occurred and you can now analyze the elements from the specific intentional torts.
