A Newton, Iowa police officer pulls over 19-year-old college wide receiver Tayvin Galanakis just after midnight for high beams. Despite Galanakis immediately agreeing to tests and blowing 0.00 on a roadside breath test, the officer arrests him for OWI/DUI anyway. At the station, a Drug Recognition Expert evaluates him and concludes he shows no signs of alcohol or drugs—he’s released with no charges after hours in custody. Bodycam/video later goes viral, and Galanakis sues the city and officers (Nathan Winters and Lt. Christopher Wing) for false arrest and civil-rights violations. A federal judge lets his case move forward and denies qualified immunity in key parts, meaning a jury can decide whether his rights were violated. I’ll walk through the stop, the tests, why a 0.00 should have ended this, how DREs are supposed to be used, and what “qualified immunity” really means. Then I’ll compare this to what should happen in a lawful impaired-driving investigation—step by step.
