This video attempts to dispel confusion about what the new federal racial hatred laws in Australia prohibit. It discusses these provisions in the Combatting Antisemitism, Hate and Extremism (Criminal and Migration Laws) Act 2026.
It explains how the proposed stand-alone criminal offence of promoting or inciting racial hatred was dropped from the law, but how inciting racial hatred remains relevant to the provisions which permit the banning of 'prohibited hate groups'.
It then explains who has the power to ban such groups and the procedure for doing so (which has changed somewhat since the previous video on banning hate groups). It explains how the term 'hate crime' is defined - including its relationship with the symbols of prohibited hate groups. It also discusses how such a law might be used and briefly notes the challenges that might be brought to its validity.
