Hi friends, today we discuss an important question about marital law: can a husband legally divorce his wife simply because she does not obey him?

Under Indian matrimonial law, marriage is a partnership of equals — not a relationship of command and obedience. A wife’s disagreement or refusal to follow her husband’s wishes is **not by itself a valid legal ground for divorce**.

Courts grant divorce only on specific statutory grounds such as cruelty, desertion, adultery, or other legally recognized reasons. Normal disagreements, independent decision-making, or asserting personal autonomy do not automatically amount to cruelty or misconduct in the eyes of the law.

Every spouse has individual legal rights, dignity, and freedom within marriage. The law protects both partners and focuses on serious breakdown of the marital relationship — not on enforcing obedience.
