What is a Fake FIR?
A fake FIR (First Information Report) is a complaint that is deliberately false or fabricated, filed with the police with the intention to mislead or harass someone.
Legal Consequences of Filing a Fake FIR:
Under Indian Penal Code (IPC):
Section 182 IPC – Giving false information to a public servant:
Punishment: Up to 6 months in jail or fine, or both.
Section 211 IPC – False charge of offence made with intent to injure:
If the false charge is of an offence punishable by death, life imprisonment, or 7+ years in jail: Up to 7 years' imprisonment and fine.
Section 499/500 IPC – If the false FIR harms someone's reputation, it may also count as defamation.
What to Do If You're a Victim of a Fake FIR:
Collect evidence to prove your innocence.
File a complaint to a senior police officer or SP (Superintendent of Police).
Approach the High Court under Section 482 CrPC to quash the FIR.
File a counter-case for malicious prosecution under relevant IPC sections.
