Introduction:
Hiba or simple is a transfer of determinate without an exchange. Juristically it is treated as a contract consisting of a proposal or offer on the part of the donor to give a thing and of acceptance of it by the donee. Until acceptance the gift has no operation. The donor must complete his intention to delivering possession of the property to the done and if possession is not given the property remains entirely at disposal of the donor and on his death it will descend to his heirs.
