Employees who are “on call” may or may not need to be compensated depending on how restricted they are during that time, especially if they must remain at their workplace.

In response to administrative challenges, the 2000 Worker Economic Opportunity Act excluded stock options and certain bonuses from overtime pay calculations. Recent discussions around FLSA reform focus on offering more flexibility, including proposals that would allow employees to choose compensatory time off instead of receiving overtime pay. The FLSA remains a foundational law shaping how work is compensated and protected in the U.S. today.
