In a major blow to the Mamata Banerjee government, the Supreme Court on February 5, 2026, ordered West Bengal to pay long-pending Dearness Allowance (DA) arrears to nearly 20 lakh state government employees from 2008 to 2019. The court ruled DA as a legally enforceable right, rejecting the state's financial constraints excuse. As per government estimates, this will cost around 43 thousand crore rupees (₹43,000 crore), creating a massive financial burden. The SC directed immediate release of at least 25% of the arrears by March 6 (or March 31 in some reports), and formed a high-level committee led by former Justice Indu Malhotra to calculate exact amounts and oversee the payment schedule. This ends years of delay since the Calcutta High Court 2022 order, giving big relief to employees who were getting only 18% DA compared to central employees' 55-60%.
