Описание: Recently, the Allahabad High Court ordered the Uttar Pradesh government to conduct urban local body elections without reservation for OBCs. In this case, the court refused to accept the arguments of the government. The court was of the view that the government has not full fill the triple test required in the context of local body elections. In this case, the court had also rejected the provisional draft order of the Uttar Pradesh government. Along with this, the court had ordered the government to hold elections on the fixed date considering OBC seats as general seats. But further the Uttar Pradesh government challenged it in the Supreme Court. While hearing on this, the Supreme Court has stayed the decision of the Allahabad High Court. The apex court accepted the government's argument that it would complete the triple test and other necessary exercises in three months. The Supreme Court also accepted that this decision of the High Court is in violation of the constitutional and statutory norms of reservation for OBCs. Therefore, it becomes necessary for us to know the aspects related to this issue. हाल ही में इलाहाबाद हाईकोर्ट ने उत्तर प्रदेश सरकार को OBC के लिए आरक्षण के बिना शहरी स्थानीय निकाय चुनाव कराने का आदेश दिया था। इस मामले में कोर्ट ने सरकार की दलीलों को मानने से इनकार दिया। कोर्ट का मानना था कि सरकार ने स्थानीय निकाय चुनावों के संदर्भ में जरूरी ट्रिपल टेस्ट को पूरा नहीं किया है। इस मामले में कोर्ट ने उत्तर प्रदेश सरकार के अनंतिम ड्राफ्ट आदेश को भी खारिज कर दिया था। इसके साथ ही कोर्ट ने सरकार को OBC सीटों को सामान्य सीट मानते हुए तय तारीख पर चुनाव कराने के आदेश दिये थे। लेकिन, आगे उत्तर प्रदेश सरकार ने इसे सुप्रीम कोर्ट में चुनौती दी। इस पर सुनवाई करते हुए सुप्रीम कोर्ट ने इलाहाबाद हाईकोर्ट के फैसले पर रोक लगा दी है। शीर्ष कोर्ट ने सरकार की इस दलील को मान लिया कि वह ट्रिपल टेस्ट सहित अन्य जरूरी कवायदें तीन महीने में पूरा कर लेगी। सुप्रीम कोर्ट ने यह भी माना कि हाईकोर्ट का यह फैसला OBC के लिए आरक्षण की संवैधानिक और वैधानिक मानदण्डों का उल्लंघन है। इसलिए, हमारे लिए इस मुद्दे से संबंधित पहलुओं को जानना जरूरी हो जाता है। इसीलिए आज के आर्टिकल में हम जानने की कोशिश करेंगे कि ‘पंचायती राज’ व्यवस्था में विभिन्न वर्गों के आरक्षण के संदर्भ में संविधान क्या कहता है। इसके साथ ही समझेंगे कि निकाय चुनावों में आखिर OBC के आरक्षण को लेकर ही क्यों सवाल उठते हैं। इस मुद्दे पर कोर्ट और सरकार की राय अलग क्यों होती है। इस संदर्भ में हम जानने की कोशिश करेंगे कि निकाय चुनावों में OBC के आरक्षण के बारे में संविधान में क्या प्रावधान हैं। इस आर्टिकल में हम यह भी जानेंगे कि यह ‘ट्रिपल टेस्ट’ क्या है, जिसे कराने के लिए कोर्ट ने सरकार को आदेश दिया है।
