✨ How to Start Studying the Constitution of India? ✨
Many law students and young lawyers make the mistake of approaching the Constitution like any other statute—starting from Article 1, then 2, 3, 4, 5… But the Constitution of India is not meant to be studied line by line in sequence.
📌 In this video, I explain:
• Why the Constitution is unique – unlike statutes, its definitions appear in Article 366, with Article 367 guiding interpretation through the General Clauses Act.
• How continuity of pre-Constitution laws (like the Indian Contract Act, Transfer of Property Act, and CPC) is ensured through Article 372.
• Why Articles 394 & 395 are crucial—one dealing with commencement and the other with repeal of earlier enactments.
• How to develop a questioning approach – for example, studying Article 141 by asking: What happens if a lower court judge refuses to follow a Supreme Court ruling?
• The right way to progress – start with short commentaries, gradually move to standard authoritative commentaries.
