This clip is from the fifth day of Committee Stage (21 May 2025), where our Chairperson, Lord John Hendy KC, spoke about the already challenging process of bringing a successful unfair dismissal claim at tribunal- a claim that currently can only be made by workers who meet the two year qualifying period.
The Bill seeks to correct this by introducing a number of 'day-one rights' for workers, including the right to bring an unfair dismissal claim. However, these provisions are facing scrutiny in the House of Lords, with some members echoing concerns from employers and business groups that extending unfair dismissal protections to all employees could negatively impact employment.
In this clip, Lord Hendy reminds us that under the current regime, an entire category of worker can be dismissed unfairly for extreme reasons without resort to justice.
