The Supreme Court has reiterated that police summons / notice under Section 35 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 cannot be served electronically such as WhatsApp, email or SMS.
The Court held that since non-compliance of Section 35 notice can lead to arrest, strict interpretation protecting personal liberty under Article 21 must be followed.
