In late February 2026, a lawsuit in Manhattan state court accusing Valve Corporation: the developer and distributor behind Steam and popular titles like Counter-Strike 2, Team Fortress 2, and Dota 2 of violating New York’s gambling laws by promoting “illegal gambling” through in-game loot boxes. According to the complaint, players pay real money for “loot box” keys that give them a chance to receive rare virtual items. These items, while cosmetic in nature, can be resold for real money on Valve’s Steam Community Market or third-party platforms, and the attorney general’s office says this model closely resembles slot machines and has generated billions of dollars in revenue. James argues that the mechanics are particularly harmful to minors and that exposing young players to randomized monetization escalates the risk of gambling addiction.
The lawsuit seeks a permanent ban on Valve’s ability to offer or promote these gambling-like features in New York, restitution for affected consumers, disgorgement of alleged profits, and fines under state law. It frames loot boxes as “quintessential gambling” that targets both children and adults without appropriate licensing or safeguards. Valve has not publicly responded to the suit as of the latest reports. Legal analysts note that this action could signal broader regulatory scrutiny of loot box and randomized monetization practices across the video game industry
