The new changes to IR35 that will be imposed upon so call Large and Medium sized businesses will compel them to make crucial decisions about the status of any workers who work for them using a personal service company. Lack of knowledge, or simple fear of getting it wrong, will inevitably result in many decisions being made that are not correct.
Whilst HMRC want everyone to be subject to be subject to PAYE as if they are employees, even when they are clearly not, they must abide by the law. Whether someone is employed ( or deemed employed ) or self-employed is a question of fact. With the right action you can ensure that the balance of any decision on this issue falls on the side of self-employment and thereby defeat IR35.
