The way mediation is set up is that both parties meet together with a mediator. A mediator is not a judge, they are a neutral party that tries to help both sides come to a peaceful and fair conclusion to the problem. The first thing that a mediator does, explains why mediation is a good option. They explain that mediation allows the parties do not have to risk going to a jury trial which can be years down the road and that the problem can likely be solved today. Each side then has the opportunity to make an opening statement, explaining their side of the story and what monetary damages they are expecting. From that moment on, both parties are separated in different rooms and the mediator goes back and forth, trying to reach a settlement. Mediation is a great way to settle outside of court and unclogs the court system.
