You, the PARTICIPANT, acknowledge that you will be participating in open educational resource (OER) chemistry experiments demonstrated on the EXPERIMENTIUM channel. You agree and understand that the experiments involve the handling of potentially hazardous chemicals and materials, very high or very low temperatures, explosions, or fire, and you agree to take full responsibility for your own safety and the safety of others around you.
You agree that you will be responsible for the use of the experiments and curricula generated through EXPERIMENTIUM, and you agree to defend, indemnify, and hold harmless the University of Houston System, University of Houston-Downtown, EXPERIMENTIUM, and their respective regents, officers, directors, employees, consultants, creators, representatives and agents (collectively “EXPERIMENTIUM Indemnitees”) from and against all claims, liabilities, damages, injuries, losses, and expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with your access to, use of, or alleged use of the EXPERIMENTIUM content. You hereby release the EXPERIMENTIUM Indemnitees from any and all claims, demands, actions, or causes of action arising out of or in connection with your participation in the experiments.
You certify that you are at least 18 years of age and competent to enter into these Terms of Release and Indemnification, or, if you are under 18 years of age, you certify that your parent or legal guardian has read and consented to these Terms of Release and Indemnification on your behalf.
You acknowledge that you have carefully read and fully understand these Terms of Release and Indemnification, that you understand and agree that participating in any EXPERIMENTIUM experiments constitutes consent to these Terms, and that you voluntarily consent to these Terms.
