An undocumented non-union carpenter working at a Manhattan construction site was struck by an unsecured 50-pound wood beam that fell from 10-12 feet above him. Despite his legal status, he had been hired and working at the site for days before the accident occurred.
The impact caused severe injuries to his head, neck, back, shoulder, and knee, leading to a multitude of surgeries. The Defendants denied that our client was even employed at the site. Through discovery and depositions, Block O'Toole & Murphy Partner Joseph Donahue and his team proved our client was working there, and that the beam should have been secured to the jack. We moved for summary judgment under Labor Law 240, and the court granted our motion.
When the case was finally placed on the trial calendar, the Defendants agreed to meaningful settlement discussions, resulting in a $5,500,000 settlement for our client.*
