Happy "SNOW WAY!" FRIDAY
On 10/17/24 around 12:27 pm, I was traveling eastbound on Interstate 40. I observed a red/ white mini cooper with Tennessee license traveling in front of me. I noticed the vehicle was traveling around 67 miles per hour and was weaving inside it's lane. I could also see there were items in the rear of the vehicle covered by a blanket. Near the 87 mile marker, I observed the vehicle cross the center line twice. I stopped the vehicle for the violation near the 87 mile marker. I approached the vehicle from the passenger side. I noticed the driver only rolled the window down a few inches before I asked him to lower it further. I identified myself to the driver and told him the reason for the stop. The driver was later identified as Danh Huynh.
Huynh said he was not speeding and I told him again the reason for the stop. I noticed Huynh's hands were shaking and he had face tremors. This continued throughout the stop. Huynh handed me a California driver's license. I asked Huynh if he lived in California. He said he recently moved to Tennessee. I asked Huynh if he worked and he told me he did construction. I asked Huynh where he was comin from and he said California. Huynh said he went to California to get somethings. I asked Huynh how long he was in California and he said about 3 weeks. (According to LPR, Huynh was westbound in Lonoke County, AR on 10/6/24).
I asked Huynh for his insurance and as he looked for it on his phone, I asked what was under the blanket. He said clothes. I asked Huynh if he could pull up the blanket and show me what was under it. Huynh pulled up the blanket just a few inches and I could see a trash bag. Huynh was still trying to pull up the insurance on his phone and I asked him to step out and come back to my patrol car. While at my patrol car, I asked Huynh more about his trip and ran his information through ATLAS. I asked Huynh if he comes through here very often and he said no. I ran Huynh's vehicle through ELSAG LPR and it showed making this trip around 12times since May 2024.
I asked Huynh how long ago he moved to Tennessee and he said a few months ago. I asked Huynh more about his job. Huynh said he was a handyman and did odd jobs and that he worked for himself. I asked Huynh if he had been in trouble before and he said no. A criminal history check confirmed that. I confirmed with Huynh that he was in California a few weeks and I asked him what day he left Tennessee. Huynh said he didn't know. Huynh said he went to sign some papers and look at some property. I tried to make since of his story but never could. He was being very vague. At this point I explained to Huynh that I suspected he was doing something he wasn't supposed to be doing. I asked Huynh if I could search his car. Huynh said he wanted to be honest with me and said there was marijuana in the car.
I confirmed with Huynh that he was telling me there was marijuana in the car and he said yes. I read Huynh his Miranda rights. I asked Huynh if the marijuana was coming from California or Oklahoma and he said Oklahoma. Huynh said he didn't make a lot of money and he was just doing this for the money. I asked Huynh if he only did the transportation part and he said yes. I placed Huynh in custody. Before I searched the vehicle, TFC. Tanner Hess deployed his K9 to sniff the vehicle. TFC. Hess' K9 gave an indication to the odor of narcotics coming from the vehicle. A search of the vehicle disclosed 6 large bags with smaller vacuum sealed bags of marijuana inside totaling 138 pounds.
DTF came to the scene and drove the vehicle to the Drug Task Force office. DTF Commander and Agent interviewed Huynh. Huynh consented to a search of his phone and the information was extracted through cellbrite. I turned over the marijuana and vehicle to DTF Agent according to ASP Policy. Huynh was placed in the Pope County Detention Center and charged with Possession with the purpose to deliver marijuana 100-500 pounds, Felony Possession of Drug Paraphernalia and driving left of center.
