It’s a nightmare scenario, you’re selling your property, you list your property, find a buyer, negotiate repairs, the time comes to close and boom. Title issue. For title to be able to issue a title insurance policy on your home they need what they call an unbroken chain of title. That means that everyone who could have possibly had an interest in the property has been identified and released any claim they might have had.
•Did you add your child to the title in a medical emergency?
•Are you and your ex having a dispute about child support?
•Is there a lawsuit involving the property in any way?
It’s easy to forget some of these events over the course of a decade or so but they will absolutely show up on a preliminary title and possibly kill your hard won deal. So how can you avoid all this? Thankfully, it’s super easy. Get a preliminary title report from your title company before you list, or at the very least before you get into escrow. This will give you all the time you need to resolve the problem or at least let any potential buyer know that an issue exists and you might need extra time to resolve it.
