Dower, also known as Mahr, is a fundamental concept in Muslim marriage. It refers to the amount of money or property that a husband is obligated to pay his wife as part of the marriage contract. The payment of dower is considered an important part of Muslim marriage as it serves as a form of financial security for the wife in case of divorce or the death of the husband.
Under Islamic law, dower is considered the exclusive property of the wife, and she has the right to claim it at any time. The amount of dower is negotiated and agreed upon at the time of the marriage, and it can be paid in full or in installments as per the agreement between the parties.
Dower can be categorized into two types: prompt dower and deferred dower. Prompt dower is the amount that is agreed upon to be paid immediately after the marriage ceremony, while deferred dower is the amount that is agreed to be paid in case of divorce or the death of the husband.
It is worth noting that the payment of dower is considered a mandatory requirement for the validity of a Muslim marriage. In case a husband refuses to pay the dower, the wife has the right to approach the court to seek its payment. Similarly, if a husband is unable to pay the dower, the court may order him to pay it in installments or reduce the amount as per the circumstances of the case.
Overall, the concept of dower serves as an important form of financial security for Muslim women and is an essential part of Muslim marriage.
