While there is no set deadline to apply for PACT Act claims, it is crucial to act promptly. By submitting your application for PACT Act presumptive conditions before August 9, your eligibility may be retroactively effective from August 10, 2022—the day the bill was signed into law.
There will never be an end date for filing a claim for presumptive service connection under the PACT Act. When a new law creates a new entitlement or changes eligibility, there is a one-year period that allows a veteran to file a claim under the new law and possibly receive retroactive payments back to the date the bill was signed into law, Aug. 10, 2022, in the case of the PACT Act.
This means that the earlier a veteran applies for PACT Act benefits, the more likely they are to receive retroactive payments back to August 10. Additionally, if you wait until after the one-year period has expired, any potential awards will only be effective from the date your claim is approved—not from August 10. This could significantly reduce any potential awards you may be entitled to receive.
It is important to note that while the one-year filing period gives a veteran an opportunity to claim retroactive benefits, it does not mean they are guaranteed any payment for past services or injuries. The Department of Veterans Affairs will still need to review and approve any claims submitted under the PACT Act, just as it would for other VA disability benefits.
