Texas Business and Commerce Code Section 302 just dropped a major update—and it’s about to change how ecommerce brands use SMS marketing. Starting September 1, 2025, if you're sending promotional texts to Texas phone numbers or operating from Texas, you’ll be classified as a “telephone solicitor” under state law. That means: you need to register with the Secretary of State, pay a $200 fee, file a $10,000 bond, and follow strict compliance rules—or risk massive fines per text.
