Diabetics who take a DUI breath test often generate falsely high readings, as these prominent California DUI defense lawyers explain.
Diabetics often go into a state of "ketoacidosis" to where the body uses fat for fuel and produces ketones and isopropyl alcohol, which DUI breath test machines mistake for ethyl alcohol.
The consequence is that someone with diabetes will often register a much higher reading on the breathalyzer than their true blood alcohol content (BAC). This causes many innocent motorists, who are basically sober, to appear intoxicated and get wrongly arrested and charged with driving under the influence.
In this video, Los Angeles DUI defense attorney John Murray explains the concept, as well as how to use expert testimony to present this DUI defense in court. It's a discussion that any diabetic who is charged with DUI in California should hear and consider.
