In a landmark judgment, a two-member bench of the Supreme Court of Pakistan, comprising Justice Ayesha A. Malik and Justice Naeem Akhtar, decided the case of Dr. Samia Haider under the Dissolution of Muslim Marriages Act. The petitioner sought dissolution on grounds of husband’s second marriage without permission, cruelty, and non-payment of maintenance while she pursued higher education abroad.
The Supreme Court strongly criticized the use of terms like “obedient wife”, holding that such language undermines women’s dignity. The Court ruled that a wife pursuing education or career is still entitled to full maintenance, including educational expenses. It further held that second marriage without first wife’s consent entitles the wife to full Haq Mehr (prompt and deferred).
The Court also enhanced child maintenance, recognizing special medical needs, setting an important precedent for family courts nationwide.
