Most people believe a compromise decree is final and cannot be challenged, that’s wrong.
Yes, Order 23 Rule 3 CPC allows courts to pass a decree based on compromise.
And Order 23 Rule 3A bars filing a separate suit to challenge it.
But here’s the key exception:
If the compromise itself is alleged to be fraudulent, unlawful, or obtained by misrepresentation, it can be challenged before the same court.
The Supreme Court made this clear in Banwari Lal v. Chando Devi (1993).
This is a classic CPC concept examiners love to test.
