hi my name is David P Shapiro I'm the owner and managing partner of the law office of David P Shapiro located in San Diego California where my firm helps good people we gain control of the future when charged with a crime this video I want to talk to you about a concept known as deferred prosecution in juvenile court well first what is it well it's what it says it is deferred prosecution meaning the prosecutor is deferring or delaying bringing formal charges against a minor in juvenile court and they'll do that for a couple of different reasons sometimes they'll do that because you know they may need some additional information other times they may do that because it's the right thing to do other times they may do that because of the availability of some really great programs particularly in San Diego where where the juvenile the minor could you know quote unquote learn their lesson and be rehabilitated in the community without being subject to juvenile court without having to go through that process and have a petition in adult Court that's called a criminal complaint filed against them without having to go before a judge so deferred prosecution sometimes let's assume you have a son or you're a daughter and they get in some trouble and and the case gets referred to juvenile probation and then all of a sudden you may get something in the mail or your juvenile probation officer or your child's juvenile probation officer may be saying something about you know hey there's not going to be Court they got to go to this program or this community organization and they got to do 20 hours here and take this class and do that and you're like wait a minute isn't that an omission of guilt right if they do these programs can't that be used against them well in many if not all instances the answer is no right but where's the value of a criminal defense attorney in this well the value of a criminal defense attorney in this is one to try and push for these types of outcomes a deferred prosecution if the case may be one that's on the fence where where the district attorney May file it a petition may be filed there may be a juvenile court proceedings and then also to explain you through that process right to walk you through that process know that you have an ally do you have a voice do you have someone that you could talk to and someone that could get answers for you and your child throughout that process who could reach out to the district attorney who could reach out to juvenile probation who could reach out to that program to make sure they're doing everything they can in addition to you as a mom or as a dad to protect your child's interest at all costs so deferred prosecution again the end goal of deferred prosecution is if you do what you're agreeing to do the case never gets prosecuted there's no juvenile court record there's no juvenile court proceeding and in many instances that's the preferred outcome once you find yourself on the cusp of potentially winding up in the juvenile court system is to have this deferred prosecution outcome there's also some possibilities even when charges are filed where you might be able to get that outcome in juvenile court but it's always preferred if you could do it before you even get there and in many instances the right attorney at the right time could help facilitate that so if you or your child find themselves going to juvenile court on a matter and have some questions we very often will have the answers for you 619-295-3555
