Right now, only 4 states in the United States still allow an individual to sue the person who had an affair with their spouse for alienation of affection or criminal conversation, with North Carolina being one of them. In order for such a suit to be successful, alienation of affection and/or criminal conversation needs to be proven in court. Regarding alienation of affection, this involves proving there was love and affection in the marriage before the affair, that the love was destroyed by the affair and that the plaintiff has suffered damages as a result. Alienation of affection does not require proof of intercourse. Criminal conversation, on the other hand, does require proving that the spouse and affair partner had intercourse, as well as proving that the innocent spouse was damaged as a result.
