If a tenant falls behind, Wisconsin Statute § 704.90 outlines your rights as an owner. Here’s the basic process I follow:
Notice of Default: Sent after non-payment (typically 5–10 days late).
Lien Notice: A certified letter is sent to the tenant with intent to sell if unpaid (minimum 14 days before sale).
Public Advertisement: Auction must be publicly posted — often via newspaper or online platform — at least two weeks prior.
Auction Day: Units are sold as-is to the highest bidder. Proceeds cover unpaid rent and expenses — any surplus must be returned to the tenant (if claimed).
