The new Special Allowance provisions are considered a violation of the Bank of Baroda vs G Palani Supreme Court judgment primarily because they achieve a similar result as the Explanation to Pension Regulation 2[s] Sub Para C—that was struck down by the Supreme Court—by manipulating the composition of pay for pension calculation, thereby taking away accrued rights and conflicting with mandatory regulations.
The overall implication of the new provisions (Para 6 of Joint Note dated 25th May 2015 and Pension Regulation 2[s] Sub Para D) is akin to what was attempted previously by the bank. The Supreme Court struck down the Explanation to Pension Regulation 2[s] Sub Para C on three main grounds, covered in our podcast on this subject tomorrow.
