In this video, I break down a common question: Do you have to be currently employed to apply for the EB1A green card?
Here’s the short answer: No, there is no legal requirement to be working or employed by a sponsoring employer to apply for EB1A. You can even self-petition without a job. However, having a current job that clearly demonstrates your extraordinary ability in your field makes your case much stronger and easier for USCIS to approve.
I also discuss scenarios like being between jobs, on parental leave, or working in seasonal or contract roles (like performers, musicians, or actors) — and how those situations affect your petition. Additionally, I explain why, if you’re outside the U.S., obtaining an O-1 visa first can be a strategic move while pursuing your EB-1A green card.
Whether you’re employed, unemployed, or self-employed, this video will help you understand your options and how to strengthen your EB1A petition.
