Описание: Legal positivism focuses on the question: is this a valid law? It attempts to answer this question by tracing law back to a source (the commands of a sovereign, a rule of recognition, or a Grundnorm) and to identify the content of law without necessarily including questions of morality. This video looks at the thought of Thomas Hobbes, Jeremy Bentham, John Austin, and H.L.A Hart and asks how their legal positivism relates to their other philosophical convictions which were in most cases utilitarian and atheistic.
