ASIC Deputy Chair Sarah Court has slammed the ASX for its alleged “collective organisational failure”.
Her remarks come as the corporate regulator, ASIC, took an unprecedented step on Wednesday by launching proceedings in the Federal Court against Australia's stock market operator, the ASX.
It relates to statements the ASX made in February 2022 that its plans to replace its operating system CHESS with a Blockchain system, similar to what is used to transact Bitcoin, were on track and progressing well.
However, In November that year, the ASX scrapped the project at a cost of $250 million.
“There’s not one person here or one person there that is the appropriate person to hold for account here,” she told Sky News Business Editor Ross Greenwood.
“This is across ASX, it’s collective and it’s organisational.
“We have therefore chosen, and the evidence has pointed us to that ASX, the corporate entity, is the appropriate respondent in these proceedings.
“And indeed, that is the first time that ASIC has taken this kind of action against ASX.”
